SC Rules Out Total Firecracker Ban, Sets Focus on Time Limits

The Supreme Court on Wednesday indicated that it would not impose a complete ban on firecrackers, while also ruling out their unrestricted use throughout the day.
A bench of Justices MM Sundresh and PB Varale said a balanced approach was necessary, with fireworks allowed only during designated hours. The court observed that a blanket ban could affect public sentiments, whereas unrestricted bursting of crackers could adversely affect children, elderly people, patients and other living beings.
During the hearing, Additional Solicitor General Aishwarya Bhati submitted that limited relaxation could be considered for specified “next-generation joined green crackers” recommended by CSIR-NEERI.

These crackers are designed to reduce emissions and use lower quantities of barium salts. The proposed permission would apply only to licensed manufacturers and products meeting prescribed noise and safety standards and containing no prohibited chemicals.
The Supreme Court said it would examine the issue of barium in firecrackers on October 15.
Last year, the court had allowed the sale and use of approved green crackers in Delhi-NCR under specified conditions, including restrictions on the hours during which they could be used.
