Airfare Surge Rules to Be Finalised in Three Weeks

The Centre has told the Supreme Court that new rules to regulate India’s aviation sector will be finalised within three weeks. The move comes amid the court’s concern over sharp and unpredictable increases in airfares.
The government presented the draft rules to a bench of Justices Vikram Nath and Sandeep Mehta in a sealed cover. The Centre said the rule-making process has been fast-tracked and final discussions are underway.
The Supreme Court asked the government to publish the rules within seven days and warned airlines of strict action if they fail to comply with regulatory requirements.


The case was filed by social activist S Laxminarayanan, who has sought a stronger and independent aviation regulator to protect passengers and bring greater transparency to airfare and additional charges.
The petitioner has alleged that airlines are charging excessive fares, particularly during festivals and periods of high demand. The plea also challenges dynamic pricing, reduced baggage allowances and various additional charges imposed on passengers.


The Supreme Court had earlier said that airfares should be rationalised and had raised concerns over what it described as the exploitation of passengers through excessive fare hikes.


The new rules are being framed under the Bharatiya Vayuyan Adhiniyam, 2024, which came into force in January 2025. The court has now scheduled the next hearing for September 7.
